By accessing or using sickaura.com (the "Site"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site.

02What this Site is

The Site is a coming-soon marketing page for SICK AURA, an apparel brand by Sick Aura Inc. The first drop, "Make 001", is planned for September 1, 2026. The Site does not yet sell products: there is no checkout, no account, and no payment is accepted through this Site. Anything described as "reserve" is an expression of interest only and creates no obligation to buy or sell.

The Site contains forward-looking statements — including planned launch dates ("Make 001 — September 1, 2026"), product features, and availability. These statements reflect our current plans and are subject to change without notice. Drops may sell out, shift, or be cancelled. The Site is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or accuracy of information. We do not warrant that the Site will be uninterrupted, error-free, or secure. Product images, availability, and forward-looking timelines are provided in good faith but without guarantee.

08Limitation of liability

To the maximum extent permitted by law, Sick Aura Inc., its officers, directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the Site, including lost profits, lost data, or interruption of service, whether based on contract, tort, strict liability, or otherwise — even if advised of the possibility of such damages. Total aggregate liability shall not exceed USD $100.

09Indemnification

You agree to indemnify, defend, and hold harmless Sick Aura Inc. and its affiliates from any claim, loss, liability, expense (including reasonable attorneys' fees), or damages arising out of: (a) your breach of these Terms; (b) your misuse of the Site; (c) your violation of any law or third-party right.

10Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or related to the Site or these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this paragraph prevents either party from seeking injunctive relief in any court of competent jurisdiction.

11Modifications

We may modify these Terms at any time. When we do, we will update the Effective date at the top of this page. Continued use of the Site after a modification constitutes acceptance of the revised Terms. Material changes will be flagged on the homepage before they take effect.

12Severability, entirety, survival

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy policy and Cookie policy, constitute the entire agreement between you and Sick Aura Inc. regarding the Site. Sections 4 (Intellectual property), 7 (Disclaimer), 8 (Limitation of liability), 9 (Indemnification), and 10 (Governing law) survive termination of your access.
