DRAFT — COUNSEL REVIEW PENDING. These terms are a good-faith first draft for the coming-soon landing only. They will be replaced by a counsel-reviewed version before SICK AURA opens sales, and a separate set of terms will govern purchases at that time.

01Acceptance

By accessing or using sickaura.com (the "Site"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site.

02What this Site is

The Site is a coming-soon marketing page for SICK AURA, an apparel brand by Sick Aura Inc. The first drop, "Make 001", is planned for September 1, 2026. The Site does not yet sell products: there is no checkout, no account, and no payment is accepted through this Site. Anything described as "reserve" is an expression of interest only and creates no obligation to buy or sell.

03Forward-looking statements

The Site contains forward-looking statements — including planned launch dates ("Make 001 — September 1, 2026"), product features, and availability. These statements reflect our current plans and are subject to change without notice. Drops may sell out, shift, or be cancelled. Do not rely on forward-looking statements as guarantees of availability, pricing, or timing.

04Intellectual property

The Site, its source code, content, graphics, design, layout, and the following names and marks are the property of Sick Aura Inc. or its affiliates, and protected by United States and international intellectual property law:

SICK AURA, SICK, the sickaura.com domain, and any related word marks and slogans (including "Wear your aura." and "Bring the world together.")
The bicycle-kick footballer emblem, the aura glow lockup, and the Fibonacci dot-sphere / marble ball marks
The yellow / blue / red flag visual identity used across the Site

You may not reproduce, copy, modify, distribute, or create derivative works of any portion of the Site without prior written permission, except for personal, non-commercial viewing. Linking to the Site or quoting brief excerpts with attribution is permitted.

05Acceptable use

You agree not to:

Scrape, crawl, or bulk-download the Site beyond what robots.txt permits.
Use automated tools to overwhelm the Site (DoS / DDoS).
Reverse-engineer, decompile, or attempt to extract source code beyond what is publicly served.
Misrepresent the Site or its content (e.g. impersonate SICK AURA or sell counterfeit goods under the mark).
Use the Site to facilitate any illegal activity.
Collect or store personal information about other visitors.

06Third-party links

The Site links to third-party services including Instagram, Google services, jsDelivr CDN, and Google Fonts. We are not responsible for the content, accuracy, or privacy practices of third-party sites. Following a link to a third party constitutes leaving our Site; their terms apply.

07Disclaimer of warranties

The Site is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or accuracy of information. We do not warrant that the Site will be uninterrupted, error-free, or secure. Product images, availability, and forward-looking timelines are provided in good faith but without guarantee.

08Limitation of liability

To the maximum extent permitted by law, Sick Aura Inc., its officers, directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the Site, including lost profits, lost data, or interruption of service, whether based on contract, tort, strict liability, or otherwise — even if advised of the possibility of such damages. Total aggregate liability shall not exceed USD $100.

09Indemnification

You agree to indemnify, defend, and hold harmless Sick Aura Inc. and its affiliates from any claim, loss, liability, expense (including reasonable attorneys' fees), or damages arising out of: (a) your breach of these Terms; (b) your misuse of the Site; (c) your violation of any law or third-party right.

10Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or related to the Site or these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this paragraph prevents either party from seeking injunctive relief in any court of competent jurisdiction.

11Modifications

We may modify these Terms at any time. When we do, we will update the Effective date at the top of this page. Continued use of the Site after a modification constitutes acceptance of the revised Terms. Material changes will be flagged on the homepage before they take effect.

12Severability, entirety, survival

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy policy and Cookie policy, constitute the entire agreement between you and Sick Aura Inc. regarding the Site. Sections 4 (Intellectual property), 7 (Disclaimer), 8 (Limitation of liability), 9 (Indemnification), and 10 (Governing law) survive termination of your access.
